| COHVCO and Molas Pass Get Another Day in Court | | Thursday, November 17, 2005 | I wanted to let all of you know that we just had another 'day in court'. Paul Turcke flew down from Boise to represent COHVCO, the Silverton Snowmobile Association, and the Colorado Snowmobile Association in our case vs. the USFS on the Molas Pass case. This case dates back to 2000-2001, when the USFS and BLM went through a planning process that resulted in the closure of a part of this important snowmobiling area near Highway 550, restrictions against the operation of night time grooming operations, and disruption of great loop opportunities. We lost the case in District Court, and Paul argued our case today at the Federal Appeals Court.
Paul did a great job, presenting information that shows the flaws in the USFS approach to this action. And in all fairness, the Department of Justice Attorney, Matt Sanders, did a fine job as well. The panel of three judges were up to speed on the merits of the case, and asked good questions of both attorneys. I truly believe that Paul's efforts will cause the panel to think long and hard, and possibly remand the case (start the planning process over again). The panel will now convene over the next few months and issue a ruling - meaning that all there is for us to do now is wait with our fingers crossed!
This is just another example of your Coalition at work for you and your rights to recreate on public land.
